Police Officer & 11 Year Old Boy Killed, Family Hospitalized

Patton Village Sgt. Stacey Baumgartner and 11-year-old Adan Hilario Jr. were killed Sunday evening when a police chase ended tragically. Four more children and two adults in the SUV were hospitalized and are currently in critical condition. The accident happened at 7:34 PM at the intersection of TX 242 FM 1484.

Just a few minutes before the accident, Sgt. Baumgartner was at a Valero Corner Store attempting to arrest Garrett William Nee, 29, who had been seen urinating and exposing himself to customers in the gas station.

When confronted, Nee tried to run down the officer with his car, and then fled the scene. Sgt. Baumgartner gave chase to the violent and drunk criminal.

That’s when it happened.

Nee ran a red light,  Sgt. Baumgartner followed, and the officer was T-boned by an SUV holding seven innocent people. Young Adan died at the scene. The other six SUV occupants were transported to a nearby hospital, where they remain in critical condition.

Nee saw the accident in his rear view mirror, and returned to the scene of the accident. He was promptly arrested, where he further resisted law enforcement officers and was seen smirking and acting drunk.

Nee has been charged murder, two counts of intoxicated manslaughter, and six counts of intoxication assault. He’s being held on a combined $1.3 million bond in Montgomery County Jail.

Sgt. Baumgartner leaves behind a wife, a 2 year old daughter, and 5 year old son. A message on a GoFundMe Page for the Baumgartner family reads:

Stacey Baumgartner passed away this evening in the line of duty. He sadly leaves behind his wife, Donna, a daughter and son. Stacey was a wonderful husband, father, friend and co-worker, and it is a huge loss for not only his blue family but for his blood family. His family needs as much help and support during this time as they can get, let us show them as much love and assistance we can give. May our love envelope them and pray for their healing… God bless you Stacey Baumgartner, you were a good man, you will be missed.
